The Immigration Reform and Control Act (IRCA) (1986)

This is the first law to require new employees to prove both their identity and their right to work in this country. Regulations implementing this law created Form I-9, which must be completed by each new employee and the employer. Form I-9 has been updated many times since 1986. Please be sure you are using the most current version of the form. There are document retention requirements. The law prohibits discrimination against job applicants on the basis of national origin or citizenship. It establishes penalties for employers who hire illegal aliens.
